Gandhi Nagar Thar-Scooty Collision Turns Grim: BNS Section 109 Invoked After Deliberate Second Hit: DGP J&K Orders Stern Crackdown on Modified Vehicles and Rash Driving

Jammu : In a shocking twist to the Thar-Scooty collision reported on July 27 near Green Belt Park, Gandhi Nagar, Jammu Police have invoked Section 109 of the Bharatiya Nyaya Sanhita (BNS) following evidence that the scooty rider was deliberately run over a second time by the Mahindra Thar driver. The vehicle was seized the same day, and the registered owner was detained. Today, the absconding driver was successfully arrested by the police.
Incident Recap: From Negligence to Suspected Intent
The incident occurred at approximately 1:30 PM on Sunday, July 27, when a black Mahindra Thar (registration number JK02DP-9594), reportedly being driven in a rash and negligent manner, collided head-on with a scooty (JK02BS-6435) near Allora Textiles at Green Belt Park. The rider sustained severe injuries and was rushed to GMC Jammu by locals, while the Thar driver fled the scene.
Based on initial findings, FIR No. 163/2025 was registered under Sections 281 and 125(a) of the BNS at Police Station Gandhi Nagar.
However, the investigation soon revealed disturbing details. CCTV footage collected from nearby establishments and the statement of an eyewitness confirmed that after the initial collision, the Thar driver reversed the SUV and deliberately struck the already-injured rider a second time, causing grievous injuries. This prompted the invocation of Section 109 of the BNS, which deals with acts intended to cause death or severe bodily harm.
Swift Police Action and Arrest of Accused:
Acting promptly, SHO Gandhi Nagar and his team seized the Mahindra Thar and initiated a detailed mechanical and forensic examination. The vehicle’s owner was detained for questioning on the same day. After intensive efforts, police successfully tracked and arrested the absconding accused.
The investigation, being carried out under the close supervision of SDPO South and SP South, remains active, with authorities examining all angles, including digital evidence and forensic corroboration.
The injured scooty rider, still unconscious, is undergoing treatment at GMC Jammu and has now been referred to a hospital outside Jammu for advanced medical care due to the severity of injuries.
DGP’s Hardline Directive: Crackdown on Modified Thars and Reckless Driving
Taking serious note of the incident, DGP Jammu & Kashmir has issued strict and sweeping directions to all district police units.
The focus is now on a state-wide crackdown against:
• Heavily modified Mahindra Thars and other altered vehicles violating motor and safety norms
• Rash and negligent driving, particularly involving high-powered or off-road vehicles driven in urban areas
• Drunk and drug-influenced driving, now emerging as a growing threat
• Illegal racing and public endangerment, which has become a public safety hazard
The DGP has emphasized that any vehicle found to be dangerously modified or operated in violation of the law will be seized immediately, and legal action under new BNS provisions will be initiated without leniency.

In light of these orders, Jammu Police have launched special enforcement drives. Key measures include:
