JAMMU: In a decisive step to safeguard communal harmony and maintain public order, the District Magistrate of Jammu, Dr. Rakesh Minhas, has issued a detailed advisory imposing strict restrictions on the misuse of social media platforms across the district. The order, which came into effect on April 17, 2026, will remain enforceable for a period of 60 days unless modified or revoked earlier.
The directive has been issued in light of increasing incidents of provocative and misleading content being circulated on digital platforms such as WhatsApp, Facebook, X (formerly Twitter), Instagram, YouTube, and Telegram. The administration has expressed concern that such content—ranging from fabricated videos and morphed images to inflammatory messages—has the potential to incite communal tensions, disrupt public peace, and endanger lives and property in a region known for its sensitive social fabric.
Invoking powers under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, the District Magistrate has prohibited a wide range of online activities that could threaten communal harmony. These include posting or sharing content that promotes hatred between communities on the basis of religion, caste, language, or region; spreading rumours or unverified information related to law and order circulating doctored or out-of-context visuals and using social media to organize unlawful assemblies or incite violence against any group.
The order also explicitly bars content that hurts religious sentiments or encourages separatist or secessionist narratives, emphasizing that such acts pose a direct threat to the sovereignty, unity, and integrity of the nation.
Highlighting the legal framework behind the action, the administration noted that Article 19(2) of the Constitution of India permits reasonable restrictions on freedom of speech in the interest of public order and national security. It further cited provisions of the Bharatiya Nyaya Sanhita (BNS), 2023, under which offences related to promoting enmity, spreading misinformation, or inciting violence through electronic means can attract penalties ranging from fines to imprisonment of up to seven years or even life imprisonment in severe cases. Additionally, non-compliance with blocking orders under Section 69A of the Information Technology Act, 2000 may also lead to strict punitive action.
Clear directions have been issued to citizens, urging them to refrain from sharing any content that falls under the prohibited categories and to verify information through official sources before dissemination. Residents have also been asked to report any inflammatory or suspicious content to the nearest police station or cyber crime unit without delay.
In a significant move, administrators and moderators of social media groups and channels have been made jointly accountable for the content shared on their platforms. Failure to act on objectionable material may attract legal consequences under applicable laws.
The advisory also places responsibility on social media intermediaries, directing them to promptly comply with takedown requests issued by authorized officers. The government’s Sahyog platform will be used to facilitate swift communication with these platforms for content removal. Non-compliance may result in loss of safe-harbour protection and further legal action.
To ensure strict implementation, the Senior Superintendent of Police, Jammu, has been directed to enforce the order rigorously, including immediate registration of FIRs against violators. The Cyber Crime Unit will conduct 24×7 monitoring of online content, while dedicated social media monitoring cells will be established at the sub-divisional level under the supervision of Sub-Divisional Magistrates.
The District Administration has underlined that the order applies to all individuals whose online activities have the potential to impact public order within Jammu, irrespective of their physical location. Officials stressed that the advisory is a preventive measure aimed at ensuring peace and stability, urging citizens to exercise responsibility and restraint while engaging on digital platforms.
With this move, authorities aim to curb the spread of misinformation and maintain communal harmony in Jammu amid growing challenges posed by the rapid dissemination of content on social media.
