J&K Govt Waives Stamp Duty on Gift Deeds in Blood Relations: A Landmark Relief for Families.

Srinagar: In a major relief for families across Jammu and Kashmir, the Union Territory government has officially waived the stamp duty on property transfers through Gift Deeds within blood relations. The decision, aimed at easing financial burdens and promoting seamless inheritance and gifting of property among close family members, was announced through a notification issued by the Finance Department under S.O. 75.
The stamp duty waiver will come into effect from April 1, 2025, and will apply strictly to property transfers between immediate blood relatives, including father, mother, brother, sister, son, daughter, grandfather, grandmother, grandson, and granddaughter.
A Significant Step in Public Interest:
This exemption has been introduced under clause (a) of Section 9 of the Stamp Act, 1977 (XL of 1977), with the government emphasizing that the decision has been made “in the public interest.” By eliminating the additional financial burden on families transferring property within their kin, the administration aims to facilitate smoother property transactions, ensure rightful inheritance, and reduce unnecessary legal formalities.
Understanding the Stamp Duty on Gift Deeds:
Stamp duty is a tax levied on property transactions, including those made through Gift Deeds—a legal instrument used to transfer property ownership from one person to another without any monetary exchange. Previously, families had to pay stamp duty even while transferring property within their own bloodline, leading to additional expenses and complexities in inheritance matters. The latest move eliminates this obligation, making property transfers within close family members more convenient and cost-effective.
